Terms and Conditions for Each Member
These terms specify
an agreement between you as a user and MyWsup.com as the provider of online
sharing and collaboration services upon your registration. By checking the
box next to “I have read and agree with the Terms of Service” on the
MyWsup.com sign up page, you agree to be bound by these user terms and
conditions. Herein MyWsup.com refers
to the owners, employees, shareholders, developers and any stakeholders
involved in maintaining and upholding the MyWsup.com service.
Privacy
MyWsup.com values
your privacy. We have an anti-spam
policy as clearly stated on our sign up form that you will not be receiving
any unsolicited commercial email. Any members found to be sending Spam to
MyWsup.com members will be removed from the site. If you observe any spam
related activities regarding a member on MyWsup.com, please report it to us
immediately at: info@MyWsup.com.
To examine any report of member misconduct,
MyWsup.com reserves the right to take any steps necessary to protect the
security of all other members, including but not limited to MyWsup.com
staff reviewing member information of any member.
Members have the responsibility to safe
keep their own personal information. MyWsup.com advises that members do not
share their personal information including address, phone number, or other
personal information online.
MyWsup.com will use its resources to
maintain our services in a faultless working state. However, we cannot
guarantee these conditions and do not accept responsibility for any
failures, bugs, any costs, loss of profits, loss of data or consequential
losses arising from your use of or inability to access MyWsup.com or any of
our related services even where any such loss arises through our
negligence. We also exclude any liability (including liability for
negligence) for the accuracy, suitability, quality or completeness of any
information or material of whatever nature appearing on or available
through the MyWsup.com service and the value and integrity of goods and
services offered by third parties over or through the MyWsup.com service.
MyWsup.com is provided without any
warranties or guarantees unless specifically stated.
We reserve the right to suspend, restrict,
reduce or terminate your access to MyWsup.com services for any reason, and
to delete any data and files in any MyWsup.com community. We may modify or
discontinue the MyWsup.com service temporarily or permanently, with or
without notice to you.
We reserve the right to forward member
information to the any proper authorities especially upon their
request.
Indemnification
You agree to indemnify, defend and hold
harmless MyWsup.com, its subsidiaries, affiliates and any or all of its
respective directors, officers, shareholders, employees, agents, clients
and contractors from and against any loss, claim, demand, cost and expense
(including reasonable legal fees) asserted by any third party due or
arising from or in connection with your use of or conduct on MyWsup.com,
your content, your violation of these terms of services or your violation
of any rights of another member. As members, you acknowledge that we have
no control over content in MyWsup.com groups. We cannot and shall not be
held liable or otherwise responsible for any content hosted on the
MyWsup.com domain including but not limited to profile information, short
messages, topical discussions, photos, and community descriptions.
You agree that we shall not be liable to
you or any third party for any modification to or discontinuance of the
MyWsup.com service on the deletion or corruption of any data on the
MyWsup.com service, even where such modification, discontinuance,
corruption or deletion is due to our negligence.
To the extent to which your use, or the use
by any person who may be authorized by you or for whom you are responsible
(for example, as the parent or guardian of a child or otherwise under these
user terms and conditions) causes loss, damage or expense to any person
(including us), you agree to indemnify MyWsup.com, its employee and officer
from and against any liability for such losses, damages and expense
You agree that you will only use MyWsup.com
in a manner that is consistent with these member terms and conditions and
in such a way as to ensure compliance with all applicable laws and
regulations. In particular:
- Content that violates or infringes in
any way upon the rights of others, including Content which is
inaccurate, false, hateful, threatening, abusive, offensive,
harassing, unlawful, defamatory, libelous, tortuous, slanderous, invasive of privacy or publicity rights, vulgar,
obscene, profane, or is racially, ethnically or is otherwise
objectionable.
- Content that you do not have a right to
transmit under any law or under contractual or fiduciary
relationships.
- Content that infringes any patent,
trademark, trade secret, copyright or other proprietary rights of any
party.
- Content that is pornographic, sexually
explicit or contains nudity.
- Unauthorized or unsolicited
advertising, promotional materials, "junk mail",
"spam", "chain letters", "pyramid
schemes" or any other solicitation to other Members except in
those areas of the Service that may be designated for such purposes.
- Content which contains software,
software viruses, including Trojan horses, bots, worms or other
harmful or destructive components or features designed to interrupt,
destroy or limit the functionality of any computer software, hardware
or telecommunications equipment.
- Content that consists of links to other
websites that contain Content not in compliance with the Terms of
Service
- Content that you know, or reasonably
should know, cannot be legally distributed in such manner.
Where applicable, you are responsible for
maintaining the full and total confidentiality of your username and
password assigned to you on registration. As a result, you are fully
responsible for all activities which occur under them. You must notify us
immediately of any unauthorized use to which you become aware.
You are responsible for making your own
copy of any important data that you place on the MyWsup.com service
although MyWsup.com maintains back up systems for data on the MyWsup.com service, we cannot guarantee that these facilities will
not fail.
Your use of MyWsup.com carries with it no
rights in relation to copyright, trade and service marks or other intellectual
property rights in MyWsup.com. You agree not to display or use in any
manner the MyWsup.com trade and/or service marks or otherwise infringe the
Rights. Any content contained in or presented through the MyWsup.com
service by us or our advertisers is protected by our or their proprietary
rights. You will not modify, copy, reproduce, republish, upload, post,
transmit, sell or distribute in any way such content including all code and
software, unless you are explicitly authorized by us or them (as the case
may be) to do so.
MyWsup.com Communities can be public or
private. If you wish to subscribe to a private community, your admission to
that community will be at the discretion of that community’s
administrator. MyWsup.com allows you
to participate in on-line communities where users can exchange information
freely. You consent to participating in such an environment where it cannot
be guaranteed that information you submit will not be reproduced elsewhere,
including outside the MyWsup.com service.
You agree that we are in no way liable for
unauthorized reproduction or distribution of information that you submit to
the service. Information you submit will be displayed on the service and
can be printed out and distributed by users.
You agree not to use MyWsup.com or the
services made available to you on MyWsup.com such that you cause the whole
or part of MyWsup.com to be interrupted, damaged, rendered less efficient
or in any way impaired.
We do not exclude any liability for death
or personal injury due to our negligence.
MyWsup.com respects
the copyright law and intellectual property of our members, and we ask you
to respect your fellow members as well. If you feel that your rights to
copyright law have been violated, please contact us at info@MyWsup.com
and we will examine and remove the content if need be.
Revisions
MyWsup.com reserves the right to make
revisions or amendments to these user conditions at any time. Any revisions made by MyWsup.com will be
posted and available at MyWsup.com.
Changes or revisions to the terms and
conditions maintain the bind that you as a member made during user sign up
and registration.

These terms specify conditions which you as
the community administrator may act as an administrator and of a
MyWsup.com. By agreeing or being promoted to an administrator on the
MyWsup.com site, you agree to be bound by these administrator terms and
conditions.
Responsibilities
As the administrator of a community or
communities on MyWsup.com, you have the responsibility to:
- Specify
where the community belongs in the MyWsup.com category scheme
- Specify
whether the community is public – open to anyone or private – via
invitation only
You can operate a MyWsup.com community
through the MyWsup.com service without paying subscription fees. However, we
reserve the right to place advertisements for third parties in any material
contained in a MyWsup.com community. This includes but is not limited to
emails sent to MyWsup.com notifications of the community.
Invitations
You can increase the membership of your
community by inviting people to become members. The administrator or any
member is allowed to send notification of their invitation with details of
how to join the MyWsup.com community.
Member Rules
You agree that by becoming a MyWsup.com
community administrator that you also become a MyWsup.com member. You
therefore agree that the MyWsup.com member terms and conditions apply to
you, both in your capacity as a user and a MyWsup.com administrator. You
will ensure that the operation of your MyWsup.com Club does not breach the
MyWsup.com user terms and conditions. If we believe that the terms and
conditions are violated, we reserve the right to discontinue and remove
your community without notice and you may be prohibited from being an
administrator in the future.
Your role as an administrator does not
establish you as an employee, partner, shareholder, or affiliate with
MyWsup.com, or any MyWsup.com company or parent company or in any other way
establish connection with us. You will not represent yourself to any person
as being in any way connected with us (other than as a MyWsup.com community
administrator). You do not have any authority whatsoever to enter into any
agreements on behalf of us or to express any view, opinion or belief on behalf
of us. Your participation in MyWsup.com carries with it no rights in
relation to copyright, trade and service marks or other intellectual
property rights in MyWsup.com. You agree not to display or use in any
manner the MyWsup.com trade and/or service marks or otherwise infringe the
Rights. MyWsup.com trade and service marks may be included in legitimate
community information and communications that are made available to Club
members as part of the MyWsup.com service.
Revisions
We may revise or amend these MyWsup.com
community administrator terms and conditions at any time. The new community
administrator terms and conditions will be available on the MyWsup.com
service website. Changes or
revisions to the terms and conditions maintain the bind that you as a
community administrator made during creation of a community or as promotion
made to a community administrator.
